Dec'99“I tried XX” Project Application Terms

1.Applicable scope
These terms apply to the “I Tried XX” Project run by Grounding, Inc. (henceforth “the Project”), related official websites (henceforth “the Website”), and services run by affiliated companies. The Office of Operation will encompass cooperating companies and other outsourced companies to which we hold non-disclosure agreements to facilitate the running of this Project and Website.
2.Use of this Project and Website
The user agrees at the time of application to this Project that the uploaded files and the information contained in it will be visible to the Website and the services that our affiliated companies operate. The user also agrees to the terms of use of the video sharing website of the user’s choosing.
3.The Office of Operation activities
The Office of Operations will inspect the videos that the user submits, and upon verifying compliance with the terms, will judge the content. The videos may be uploaded to the Website as well as featured in Grounding’s official Facebook, Twitter, Instagram, YouTube, and other social media and media sharing platforms. The videos will be chosen at the Office of Operations discretion.
・If the user’s submitted content is found to have violated the terms, the Office of Operations will delete the uploaded data and files without notice to the user.
・The user agrees that if deemed necessary, the Office of Operation may delete the user’s uploaded content data without notice even if the content is unclear whether it violates the terms or not.
・The user agrees to not object to any action taken by the Office of Operation regarding the uploaded data files.
4.Forbidden items related to submitted files
The below actions are forbidden with respect to the user’s usage of the Website and uploaded files.・Actions that violate the law, or the assistance, solicitation, forcing or promotion thereof.
・Actions that cause problematic load to the Website server.
・Actions that obstruct the operation of the Project and Website, and any actions deemed inappropriate by the Office of Operation.
・Actions that obstruct the application process of other users to this Project.
・Usage of this Project as a form of election campaign or similar activities, as well as actions that violate voting rights.
・Actions that infringe upon an individual’s reputation, social trust, privacy, right of likeness, publicity rights, copyright, and other intellectual property rights (includes those recognized by the law or precedent). Furthermore, any actions that is seen as damaging, threatening, or abusive to other users.
・Expressions of discrimination based on race, religion, tribe or age.
・Actions that conspire, instigate or promote suicide, group suicide, self-harm, or use of illegal drugs.
・Using the Project as a means to meet other individuals for the purpose of sex or indecent activities.
・Sexual, indecent and violent expressions or actions. Any actions that cause discomfort to others.
・Uploading videos or links that contain obscenity.
・Posting links to child sex trafficking/pornography and uncensored pornographic video download sites.
・Sales, auctioning or purchasing without the consent of the Office of Operations.
・Advertisement of products and services, publishing of profile content, and other actions that solicit spam or chain mail without the consent of the Office of Operations.
・Stealing the identity of individuals or companies.
・Actions that violate the standards of decency and common sense.
・Fabrication or the spread of misinformation for the purpose of playing unintended video content.
・Any other actions that apply to the above items.
5.Submission conditions
Content submissions must satisfy the below conditions.
・Does not violate “4.Forbidden items related to submitted files” terms.
・Content using sound sources from “Dance In the Galaxy!” shared from Grounding Inc.
・Content must not contain music that is edited, has added effects or modified.
・Applicants consent to having their submitted content used for promotional purposes on TV, magazines, newspapers and other web promotions in addition to the services provided the Website and affiliated companies.
6.Cautionary items
・Applicants who are represented by an agency must obtain permission from their agency before participating in this Project.
・There will be no payment issued for any usage or non-usage of an applicant’s video.
・Applications verify that their participation to this Project is not in violation of the terms of use of your avatar.
・The applicant is responsible for obtaining permission to use any copyrighted avatars.
・The applicant understands that any submissions may be denied or unused by the Office of Operations.
・The applicant consents to the use, posting, distribution, and publicly transmittal of their submitted data indefinitely and free of cost. The details of the usage will not be communicated to the applicant on an individual basis upon usage.
・The submitted data will be stored securely and appropriately by the Office of Operation, and will not be used for any purposes outside of this Project.
・If uploading to a video sharing website, please disable any comments. Please check with the video sharing Website used for instructions on how to disable comments.
・The Office of Operations cannot accept any changes or cancellations to the content once a content has been submitted.
・The Office of Operations does not accept changes to email addresses after a successful submission.
・The Office of Operation will not edit the submitted content, outside of usage for promotional purposes.
7.Indemnities
・The video will be seen by many people, both domestically and internationally. The Office of Operations cannot take responsibility for any uploaded video.
・The applicant is responsible for resolving any libel, defamation, incidents or any conflict that arise with a third party. The Office of Operation does not take any responsibility.
・The Office of Operation does not guarantee the accuracy, legality, morality, concurrency, and appropriateness (including categorical appropriateness and applicability) of the information posted on the Website.
・The Office of Operation is not responsible for any direct or indirect damages that occurs for the usage or failure to use the Website, usage or failure to use links from the Website, or submission or failure of submission to this Project.
・The Office of Operation is not responsible for any accidents or damage to the data that occurs during the transmission of data for submission.
・The user agrees to exempt the Office of Operation from all legal action relating to the Project and Website.
・The Office of Operation is not responsible for any disputes regarding any communication fees incurred by the user during the use of the Website.
8.Use of account information
The user consents that the Office of Operation will use the applicant’s information (information included in account information) for this contest.
The applicant’s account information is used only to the extent necessary to process the application to the contest and will not be used for any other purposes.
9.Applicable law/language
These terms apply to the law of Japan, and the Tokyo Region Courthouse as the main court.
This Website and the terms of agreement will only interpreted in Japanese.
10.Changes to the Website operation and terms of agreement
Changes to the Website contents and the contents of this agreement may change without prior notice. The user agrees to any changes at the time of the change.
This Website may suspend or terminate the provided service without prior notice.
11.Uploaded videos
The rights of likeness and copyright of user-uploaded videos belong to Grounding, Inc.
12.Judging process
・The Office of Operation may individually contact the user.
・The judging process may be canceled for the submission if the user’s submitted mail address was invalid, or if we are unable to contact the user for some reason.
・We may receive the name, employer name, phone number, and email address of the applicant.
・We may request to see the driver’s license or passport of the applicant for identity verification purposes.
・The privileges granted by the judging result only applies to the applicant or the group participant and cannot be transferred to a party.
・We cannot answer questions regarding the reasons for our selections.
